Scrimgr — Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Scrimgr website and apps (the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1) Eligibility
- You must be 18 years or older to create an account or use the Service. Minors may not create accounts.
- Only a parent or legal guardian may publish a Guest Player listing for a minor and must not include child-identifying information.
- Coaches represent they are authorized by their team/club and will comply with applicable league, tournament, and athlete-safety policies.
2) Features
- Scrimmages: tools to discover, coordinate, and manage scrimmage opportunities.
- Pickup: tools to create and join informal sessions; organizers are responsible for accuracy of event details and participant safety.
- Private Training: tools to post or discover training sessions; Scrimgr is not a party to any training relationship.
- Guest Player Marketplace: parents/guardians may publish limited, non-identifying listings for minors discoverable by coach accounts.
- Chat: one‑to‑one in‑app messaging is available only inside a specific request (e.g., after acceptance or rejection) between the two adult accounts involved. Chat is not end-to-end encrypted. We may review content to enforce these Terms and comply with law.
- Notes: users may keep private notes; if you share or publish them, you are responsible for their accuracy and legality.
- Instagram: you may optionally display a handle or profile link; Scrimgr does not use Instagram OAuth and is not affiliated with Instagram. Adults are responsible for any links they share, including links referring to a minor’s profile.
3) Guest Player Marketplace
- Purpose: parents/guardians may publish a limited, non-identifying listing for a minor to be discovered by coach accounts.
- Allowed fields only: Gender, Play Age Group (e.g., U10/U11), and Playing Level (e.g., Premier 1). Do not include names, photos, school, addresses, precise/real-time device locations, schedules, or contact info in listings.
- Contact: adult users may choose to share contact details at their discretion. Do not use contact details for marketing or unrelated purposes.
- We are not a party: Scrimgr is a listing and coordination service only; we do not supervise events, transportation, tryouts, or guest-play arrangements.
4) Chat
- Scope: chat is one‑to‑one and tied to a specific request between two adult accounts. There are no group chats.
- No end-to-end encryption: chat may be stored and reviewed to enforce these Terms, investigate abuse, and comply with law.
- Prohibited content: harassment, hate speech, sexual content, exploitation, illegal activity, spam, and any content involving minors beyond permitted non-identifying listing attributes.
- Reporting: report abuse to myller@scrimgr.com. We may remove content or suspend accounts at our discretion.
5) Pickup & Private Training
- User responsibility: you are solely responsible for event information you post (date/time, venue/address or city, capacity, eligibility) and for compliance with venue rules and applicable laws.
- No supervision: Scrimgr does not supervise, control, or provide transportation, equipment, insurance, or medical services.
- Payments: Scrimgr does not process payments for Pickup or Private Training. If you arrange fees or compensation outside the Service, you are responsible for those arrangements and any taxes.
- Safety: comply with organization and venue safety policies; include another adult on communications about minors.
6) User Conduct
- No misrepresentation of identity, age, team, roster, or competitive level.
- No harassing, exploitative, pornographic, or illegal content or behavior.
- No child-identifying information in Guest Player listings or other public content; do not solicit or exchange such information in chat.
- No scraping, reverse engineering, or interfering with the Service.
- Use any exchanged contact details only to coordinate accepted activities; do not use for marketing or unrelated contact.
- Respect intellectual property rights and privacy of others.
- Instagram links: you are responsible for any Instagram handle or link you share, including links referring to a minor’s profile, and for ensuring compliance with these Terms and applicable law.
7) Content & Licenses
You retain rights in content you submit. You grant Scrimgr a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, perform, distribute, and create derivative works of your content solely to operate, secure, and improve the Service (including moderation, safety, and legal compliance). You represent you have rights to submit the content and that it does not infringe others’ rights.
8) App Stores; Account Deletion
When using our iOS app, you also agree to Apple’s terms and policies. If your app supports account creation, you can initiate account deletion from within the app settings; deletion is further described in our Privacy Policy.
9) Fees
We may offer free or paid features. Prices and billing terms will be disclosed where applicable. Taxes may apply. Scrimgr does not process payments for Pickup or Private Training unless explicitly stated in-app.
10) Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Scrimgr disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not control or guarantee user conduct, third-party services, venue availability, or event outcomes.
11) Limitation of Liability
To the fullest extent permitted by law, Scrimgr and its owners, officers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Service. Our aggregate liability will not exceed the greater of $100 or the amounts you paid (if any) in the 12 months before the claim. Some jurisdictions do not allow certain limitations; where prohibited, those limits apply to the maximum extent permitted.
12) Indemnification
You agree to defend, indemnify, and hold harmless Scrimgr from any claims, damages, or costs (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
13) Suspension & Termination
We may suspend or end your access at any time for any reason, including suspected misuse, legal risk, or safety concerns. You may stop using the Service at any time and request deletion of your account.
14) Governing Law; Disputes
These Terms are governed by the laws of the State of Utah, excluding its conflict-of-laws rules. Any dispute will be brought in state or federal courts located in Utah County, Utah, and you consent to their jurisdiction and venue. If you are a consumer with non-waivable rights in your jurisdiction, these Terms do not limit those rights.
15) Changes to the Service or Terms
We may update the Service or these Terms from time to time. Material changes will be posted here, and the “Effective date” above will show the latest revision.
